1. About us
The Motion Protocol is a physiotherapist-led online exercise brand. Our programs are created and presented by Aida, a physiotherapist with over 10 years of clinical experience. The Motion Protocol is operated by:
Ajda Mlakar s.p. (sole trader)
Šentiljska cesta 37c, 2000 Maribor, Slovenia
Tax number: 46726080
Email: [email protected]
In these terms, "we", "us" and "our" mean Ajda Mlakar s.p. trading as The Motion Protocol. "You" means the person using our website or buying our products.
2. Accepting these terms
These terms apply when you use themotionprotocol.com, access our free content, or buy any of our guides or programs. By making a purchase or using our content you agree to these terms and to our Privacy Policy. If you do not agree, please do not use our products.
You must be at least 18 years old to buy our products. Our products are sold to individuals for personal use only.
3. Health disclaimer - please read
Our program, videos, emails, social media content and any replies to your messages or comments are general exercise education. They are not medical advice, a diagnosis or a personalised treatment plan, and using them does not create a physiotherapist-patient relationship with Aida (Ajda Mlakar) or anyone else at The Motion Protocol. We have not examined you and do not know your medical history, so we cannot advise on your individual case.
Before starting the program, speak to your doctor or a physiotherapist who can assess you in person, especially if any of the following apply:
- your back pain started after a fall, accident or injury
- you have numbness, tingling or weakness in your legs
- you have pain that is getting worse, is severe at night, or comes with fever or unexplained weight loss
- you have had recent surgery, a known spinal condition, osteoporosis, cancer, or a heart or circulation problem
- you are currently under medical treatment for your back
- you are pregnant or have recently given birth
Seek urgent medical help immediately if you have loss of bladder or bowel control, numbness around your groin or inner thighs, or weakness in both legs. These can be signs of a serious condition that exercise cannot fix.
Stop any exercise straight away if it causes sharp pain, pain that spreads down your leg, dizziness, chest pain or shortness of breath, and get it checked before continuing.
4. Your responsibility and our liability
4.1 Assumption of risk. Exercise carries an inherent risk of injury, including muscle strain, joint pain and worsening of existing symptoms. By using the program, you confirm that you understand this, that you have considered the warning signs in section 3 and sought medical advice where they apply, and that you take part voluntarily and at your own risk.
4.2 Your responsibilities. You are responsible for:
- checking with a medical professional that the program is suitable for you (section 3)
- following the instructions, demonstrations and safety notes as shown
- working within your own limits and stopping if an exercise causes pain
- using a safe, clear space and any equipment in good condition
4.3 What we are not responsible for. To the fullest extent the law allows, we are not liable for any injury, pain, loss or damage that results from:
- performing exercises incorrectly or differently from how they are demonstrated
- ignoring the safety notes, the warning signs in section 3, or advice from your own doctor
- continuing an exercise after it caused pain or discomfort
- a medical condition you did not have assessed before starting
- unsafe surroundings or equipment
4.4 Limits. Subject to section 4.5, our total liability to you for any claim connected to the program is limited to the amount you paid for it. We are not liable for indirect or consequential losses, such as lost income or missed work.
4.5 What we never exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. If you are a consumer, you keep all the mandatory rights your local consumer law gives you.
5. Products, prices and payment
We sell digital products: downloadable guides and online video programs, such as our lower-back guide and our five-week at-home lower-back program. Each product's sales page describes what is included.
Prices are shown in US dollars at checkout and include any VAT or sales tax we are required to charge, unless the checkout says otherwise. Your bank or PayPal may charge a currency conversion fee. Payments are processed by Stripe or PayPal; we never see or store your full card details.
Your order is confirmed when you receive our confirmation email. We may correct obvious pricing errors and, if we do, we will offer you the choice of paying the correct price or a full refund.
6. Access to your program
After payment you receive access by email, usually within a few minutes. "Lifetime access" means access for as long as we continue to offer that program. If we ever stop offering a program, we will give you at least 60 days' notice and a way to download or keep the materials where possible.
We may update, improve or reorder program content over time. Updates will not remove the core content you paid for.
7. 14-day money-back guarantee
If you are not happy with a paid product, you can get a full refund within 14 days of purchase. No reason is needed.
- Email [email protected] within 14 days of your purchase date, from the email address you used to buy, with "Refund" in the subject line.
- We confirm your request and refund the full amount to your original payment method within 14 days.
- Your access to the product ends when the refund is issued.
Requests sent after the 14-day period are not eligible. We may decline a refund where there is clear abuse, for example repeated buy-and-refund of the same product, or sharing or downloading the content before refunding.
Statutory right of withdrawal (EU and UK). Consumers in the EU and UK normally have a 14-day right to withdraw from online purchases. For digital content, that right ends once delivery begins, if you agreed to immediate access and confirmed you understood this. You give that agreement at checkout. Our money-back guarantee replaces it: you can still get a full refund for 14 days after purchase even though you have accessed the content.
8. Your account and acceptable use
Your access is for you alone. You must not share your login, resell or give away access, or let other people use your account. Keep your password secure and tell us straight away if you think someone else has used your account.
We may suspend or close an account that breaks these terms, for example by sharing access or copying content. If we do, we will tell you why. No refund is due for an account closed for misuse.
9. Intellectual property
All content in our products and on our website, including videos, text, exercise sequences, images and the The Motion Protocol name and logo, belongs to us or our licensors. When you buy a product, you get a personal, non-transferable licence to use it for your own exercise.
You may not copy, record, download (unless we provide a download), share, publish, sell, or use our content to teach clients, run classes or create your own products without our written permission.
10. Results
Everyone's body and back pain are different. Testimonials and examples show individual experiences, not typical or guaranteed results. We do not promise that any product will reduce your pain or produce a particular outcome. Results depend on your condition, consistency and many factors outside our control.
11. Changes to these terms
We may update these terms from time to time and will show the new date at the top. The version in force when you bought a product applies to that purchase, unless a change is required by law.
12. Governing law and disputes
These terms are governed by the law of the Republic of Slovenia. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country, and you can bring a claim in the courts where you live.
13. Complaints and contact
If something is wrong, please email [email protected] first. We aim to reply within 5 working days and to resolve complaints within 14 days.
